Terms of Service

Welcome to ImgCraft ("Service"), operated at imgcraft.co. By accessing or using the Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Service Description

ImgCraft is an AI-powered image and video generation platform. We provide tools that allow users to create, edit, and enhance visual content using artificial intelligence.

2. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old or the age of majority in your jurisdiction to use this Service.

3. Ownership of Generated Content

Subject to these Terms, you retain ownership of content you create using ImgCraft. Users on paid plans may use generated content for commercial purposes. Users on the free plan are granted a personal, non-commercial license to their generated content.

You acknowledge that AI-generated content may not be eligible for copyright protection in all jurisdictions. ImgCraft makes no representations regarding the copyrightability of AI-generated outputs.

4. Prohibited Uses

You agree not to use the Service to:

  • Generate illegal content or content that violates applicable laws
  • Create non-consensual intimate imagery or deepfakes of real individuals
  • Generate child sexual abuse material (CSAM) or any content sexualizing minors
  • Infringe on the intellectual property rights of others
  • Generate content promoting violence, terrorism, or hate speech
  • Engage in fraud, impersonation, or deceptive practices
  • Attempt to reverse-engineer, exploit, or abuse the Service infrastructure

Violation of these prohibitions may result in immediate account termination and reporting to relevant authorities.

5. Credits and Payment

ImgCraft operates on a credit-based system. Credits are purchased through our payment provider, LemonSqueezy. By purchasing credits, you agree to LemonSqueezy's terms of service.

  • Credits are non-transferable and non-refundable once purchased.
  • Subscription credits are allocated monthly and expire at the end of each billing cycle. Unused subscription credits do not roll over to the next month.
  • Credit pack credits (one-time purchases) expire 12 months from the date of purchase.
  • We reserve the right to change credit pricing, allocation amounts, and plan features with reasonable notice (at least 30 days for existing subscribers).
  • Certain AI models designated as "Premium" may consume credits at a higher rate (currently 1.5× the base credit cost) due to significantly higher computational costs.

6. Fair Use Policy

To ensure a quality experience for all users, ImgCraft enforces the following fair use guidelines:

  • If your video generation usage exceeds 80% of your monthly subscription credits, we may apply rate limiting or queue prioritization to maintain service quality for all users.
  • Automated, scripted, or bulk generation that exceeds reasonable personal or business use may be throttled or suspended.
  • We reserve the right to modify fair use thresholds with prior notice.

7. Refund Policy

Due to the nature of AI generation (compute resources are consumed upon use), consumed credits are non-refundable. If you experience a technical issue that results in credit loss without receiving output, please contact support@imgcraft.co and we will review your case.

  • Unused subscription credits are not refundable upon cancellation; your plan remains active until the end of the current billing period.
  • Unused credit pack credits are not refundable after purchase.
  • Expired credits (subscription or pack) cannot be restored or refunded.

8. Account Suspension and Termination

We may suspend or terminate your account if you:

  • Violate these Terms or our prohibited uses policy
  • Engage in abusive behavior toward other users or staff
  • Use the Service in a way that threatens the integrity or performance of our systems
  • Fail to pay for purchased services

Upon termination, your access to the Service and any stored content will be revoked. We may retain data as required by law.

9. Service Availability

ImgCraft is provided on a "best effort" basis. We do not guarantee any specific uptime or service level agreement (SLA). The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We rely on third-party AI providers and infrastructure services; disruptions to those services may affect ImgCraft.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT AI-GENERATED CONTENT WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR ANY PARTICULAR PURPOSE. WE ARE NOT RESPONSIBLE FOR THE ACTIONS OR OUTPUTS OF THIRD-PARTY AI MODELS USED IN THE SERVICE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IMGCRAFT AND ITS OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. DMCA Takedown

If you believe content generated through ImgCraft infringes your copyright, please send a DMCA takedown notice to dmca@imgcraft.co with:

  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the infringing material and its location on the Service
  • Your contact information
  • A statement of good faith belief that the use is not authorized
  • A statement under penalty of perjury that the information is accurate
  • Your physical or electronic signature

13. Indemnification

You agree to indemnify and hold harmless ImgCraft and its operator from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

14. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes via email or a notice on the Service. Continued use after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Wyoming.
